This paper addresses the need for, and ultimately proposes, an educational framework to develop competencies in attending to ethical issues in mental health and substance use health (MHSUH) in healthcare ethics consultation (HCEC). Given the prevalence and stigma associated with MHSUH, it is crucial for healthcare ethicists to approach such matters skillfully. A literature review was conducted in the areas of bioethics, health professions education, and stigma studies, followed by quality improvement interviews with content experts to gather feedback on the (...) framework’s strengths, limitations, and anticipated utility. The proposed framework describes three key concepts: first, integrating self-reflexive practices into formal, informal, and hidden curricula; second, embedding structural humility into teaching methods and contexts of learning; and third, striking a balance between critical consciousness and compassion in dialogue. The proposed educational framework has the potential to help HCEC learners enhance their understanding and awareness of ethical issues related to structural stigma and MHSUH. Moreover, context-specific learning, particularly in MHSUH, can play a significant role in promoting competency-building among healthcare ethicists, allowing them to address issues of social justice effectively in their practice. Further dialogue is encouraged within the healthcare ethics community to further develop the concepts described in this framework. (shrink)

Göreceğimiz gibi bu üç adımın her biriyle ilgili ciddi sorunlar var.

Bu makalede İşrakî felsefe geleneğinin önemli bir düşünürü olan İbn Tufeyl’in, Hayy b. Yakzan isimli eserinde ortaya koymuş olduğu dini tecrübeyi ve mahiyetini ele aldık. Konuyu temellendirmek için öncelikle dini tecrübeden ne anladığımızı ve çeşitlerinin ne olduğunu tespit etmeye çalıştık. Daha sonra İbn Tufeyl’in felsefi ve teolojik arka planının ne olduğunu tespit ettik. Burada kilit rolü, İbn Sina oynamaktadır. Ancak Sühreverdî’nin görüşleri de önemli bir yer tutmaktadır. İbn Tufeyl’in en önemli kaynaklarından biri şüphesiz Gazzâlî’dir. Ancak İslam tasavvuf geleneğinde dînî tecrübe (...) konusu farklı çalışmalarda ele alındığı için Gazzâlî düşüncesine yer vermedik. Cryptocurrency has revolutionized the economic system of the world. It provides a new and innovative means of exchange that has speedily invaded the financial market trends and changed the traditional cash world. However, consumers have low acceptability for blockchain-based cryptocurrency due to increasing online scams and the absence of a regulatory framework. There is also a misconception about its usage on many platforms, which has created a clear gap in the literature to address this issue. Therefore, the current study intends (...) to investigate the effect of technology awareness on the behavioral intention of crypto users through perceived factors. It also empirically examines the moderating role of government support on these indirect paths. The underlying framework is investigated by surveying 333 respondents from the Z generation. Results revealed that perceived factors mediate the relationship between technology awareness and behavioral intention. Furthermore, government support strengthens the indirect relationship of technology awareness on behavioral intention through technology acceptance determinants, such that the effect of technology awareness on behavioral intention through perceived factors is more assertive when government support is high. The findings will provide a new dimension to different financial bodies implementing monetary policy and highlight the need to adopt innovative digital technologies in Pakistan. (shrink)

The Qur’ān Recitation is taught as a compulsory or elective course at all levels of formal in education, as well as in the courses of the Presidency of Religious Affairs in non-formal education in Turkey. In the curricula of this course, it is emphasized that the readings should be word and meaning centered and the course should be centered on the meaning of the Qur’ān. However, the achievability of these idealized goals should be discussed. In addition, due to the focus (...) of the curriculum on literally and meaningfully, there are professional difficulties in teaching the words of the Qur’ān and the programs lose their functionality. In this case, the teaching of the meaning of the Qur’ān should not be in the learning area of this course but should be the subject of a separate professional course. This study discusses the applicability of this, reminds the limits of the Qur’ān course, the importance of teaching the wording from a professional point of view, and the problematic aspect of teaching the meaning of the Qur’ān together with the teaching of the words, and clarifies how it can be done. The objective of the study is not to advocate the incorrectness of reading the meaning or to assert the principles of interpretation. The aim of the study is to contribute to the preparation of a realistic curriculum for the realization of the goals of the Qur’ān recitation courses by determining the limits of the courses in the professional field. In this context, the programs of formal schools such as imam hatip secondary school, imam hatip high school, middle and high schools, some sample the programs of the faculties of theology and the course curricula of the presidency of religious affairs were examined and evaluated in terms of teaching the meaning of the Qur’ān. Trust and trustworthiness are essential for good healthcare, especially in mental healthcare. New technologies, such as mobile health apps, can affect trust relationships. In mental health, some apps need the trust of their users for therapeutic efficacy and explicitly ask for it, for example, through an avatar. Suppose an artificial character in an app delivers healthcare. In that case, the following questions arise: Whom does the user direct their trust to? Whether and when can an avatar be considered trustworthy? Our (...) study aims to analyze different dimensions of trustworthiness in the context of mobile health app use. We integrate O'Neill's account of autonomy, trust, and trustworthiness into a model of trustworthiness as a relational concept with four relata: B is trustworthy with respect to A regarding the performance of Z because of C. Together with O'Neill's criteria of trustworthiness (honesty, competence, and reliability), this four-sided model is used to analyze different dimensions of trustworthiness in an exemplary case of mobile health app use. Our example focuses on an app that uses an avatar and is intended to treat sleep difficulties. The conceptual analysis shows that interpreting trust and trustworthiness in health app use is multi-layered and involves a net of interwoven universal obligations. At the same time, O'Neill's approach to autonomy, trust, and trustworthiness offers a normative account to structure and analyze these complex relations of trust and trustworthiness using mobile health apps. The Ottoman legal system is built on religious (sharīʿa) and customary (ʿurfī) laws. The customary law consists of the rules that are not in contrast to the sacred law. Collection of regulations (qānūnnāme) were the most effective way for the execution of the customary laws. The qānūnnāme included the sultan’s orders and edicts (farman). Ottomans regulated and evaluated the taxes through measurements of lands specific times of the year. These measurements would be recorded into the taḥrīr books (written survey of (...) immovable prop-erties). And the administrative qānūnnāme were included in these books. In the qānūnnāmes, we can find information about the taxes, and the unlawful executions of the customary actors (ahl al-ʿurf) as well as the tax regulations. The qānūnnāmes on sanjak are composed accord-ing to the economic, social, and geographical characteristics of the administrative district it is written about, and with this, they provide us information on these issues. In this article, three sanjak qānūnnāmes are taken as the central topic and Kamah, Āmid, Pojega are evaluated in terms of the execution of customary law in these districts. These qānūnnāmes include record-ings of various taxing regulations, altered and cancelled executions, amounts of taxes, and punishments. We can compare the three districts in their economic and social characteristics.Summary: The Ottoman legal system consists of sharia and customary law. Ordinary law is based on some regulations which the sultan deems necessary and is composed of laws. The Ordinary law should not contradict sharia. When the Ottomans conquered a place, they generally protected the current laws (such as Uzun Hasan's laws), except for necessary changes or cancellations. When the Ottomans conquered a place, they used to make census to determine taxes. As a result of this census, Sanjak qānūnnāmes were placed in taḥrīr books. It also involves issues such as public and criminal law, customary tax regulations, and amounts of market taxes, which are approved by the emperor. In this article, the Sanjak qānūnnāmes of different regions belonging to the period of Suleiman the Magnificent, whose dates are close to each other, were selected. The Sanjak qānūnnāmes which are studied on are Kemah sanjak of Erzurum province belonging to (937/1530) and Āmid sanjak of Diyarbekir province belonging to (947/1540) and Pojega sanjak of Budin province belonging to (950/1545). The reason for this is to be able to compare the differences or stableness in tax and practices in the mentioned date range. At the same time, attention has been paid to the effectiveness of customary practices and the parts that are linked to sharīʾa. Some of the laws of Uzun Hasan are in force in Kemah and Amid. In these two sanjaks, some of the bâc taxes and some other taxes were removed. It is seen that the complaints made by the public due to the excess of taxes are taken into consideration. For example, in Kemah, the akche of murahhasiyye paid by the villagers for Armenian priests and bishops is one of them. The taxes that are abolished include kulluk and blend tax and taxes from various business lines. The tax, which was collected by the governors of the sanjak and the castle beys under the name of custom, which was imposed by some local administrators, was cancelled by seeing bidat. When three of the sanjaks are taken together, there are cautions that unfair and unlawful tax collections made by local administrators during tax collection have been abolished and these are accepted as bidat. Kemah sanjak qānūnnāme is 13 pages in total. Kemah, which has a geographical position and military transit route, has commercial relations with cities such as Trabzon and Hasankeyf. In Kemah, there are candle mill (şemhane), creamery (bezirhane) and tavern (meyhane). Kemah is one of the places where the climate has an impact on agriculture. Kemah's economy is based on trade, agriculture, small livestock, beekeeping. In Kemah, where caravan trade is important, trade goods are of value due to its location on the transit road. The Kemah qānūnnāme also contains various taʿzīr for unjust killing, wounding, and adultery. In the city, there are some arcs have ownership in common. The fact that there are mills indicates that the rivers in Kemah are utilized. Âmid Sanjak qānūnnāme consists of two pages. The title that attracts our most attention is that there is vitality and economic activity in the market since Âmid is on the Aleppo-Mosul Silk Road. The high number of weaving looms is due to the production of cotton. Amid has dye house and saphane. Indigo and Amid's red dye sold in the market shows the importance of weaving. Pojega sanjak qānūnnāme is composed of seven pages. Among the qānūnnāmes we have mentioned, this is the most legible one. In addition to the old practices, there are some new regulations in this qānūnnāme. The pig tax is only here because of the non-Muslim population. Transit tax fees indicate trading viability. Based on the studies made on these three sanjaks, it can be said that in the qānūnnāme, the rights of the raia (reaya) were tried to be protected by the rescript of the Sultan himself. Therefore, the most remarkable things in the qānūnnāme are not allowed unfair practices of local administrators and without the need to collect taxes from the public. The dates of the qānūnnāme are close to each other and Despite geographical differences, there is no remarkable change in taxation. Although there are non-Muslim populations in all three sanjaks, it is mostly in the Pojega sanjak. The fact that the pig tax is collected only from this sanjak is evidence of this situation. The presence of meyhane in Kemah, Amid and Pojega sanjaks point to the non-Muslim population. It is also used as a place where the villagers sell their grape juice. The mill tax on Kemah and Pojega show that rivers are used in common. (shrink)

İktisadi değer taşıyor olması yönüyle şahıs varlığı haklarından farklılaşan malvarlığı hakları, herkese karşı ileri sürülebiliyor olması durumunda “mutlak”, yalnızca borçlu namındaki yükümlüye karşı ileri sürülebiliyor olması halinde ise “nisbî” şeklinde nitelenir. Mutlak mamelek hakları somut bir kütleye sahip olan (cismanî) bir konu üzerine kuruluysa aynî hak adını alır. Aynî haklar, nisbî özellik taşıyan ve dolayısıyla belirli bir şahsın edimi (...) sayesinde ve ancak onun aracılığıyla kullanılan alacak haklarıyla birlikte malvarlığının iki önemli bileşenini oluşturur. Tarihsel süreçte bu iki hak türünü birbirine yaklaştırmaya yönelik çeşitli teşebbüslerde bulunulmuşsa da bu haklar gerek mahiyet gerek hüküm itibariyle farklı kabul edilmeye devam etmiştir. Söz konusu farklılık, hakkın konusu üzerindeki hakimiyetin şekli yani doğrudan veya dolaylı olması bakımından, bahse konu hakların eşyanın aidiyetine etkisi açısından, hakkın mutlak veya nisbî olması cihetinden, sürekli olup olmama yönünden ve makalede etraflıca ele alınacağı üzere öncelik/üstünlük itibariyle ortaya çıkmaktadır. Kara Avrupası hukuk sistemine ait olan bu kavramsal kurgu ve terimlerin muadillerine veya benzerlerine İslam hukuk doktrini içerisinde de rastlanmaktadır. Bu kapsamda fıkıh literatüründe malvarlığı haklarının tümüne şamil olacak şekilde “milk” terimi kullanılmış, hakkın konu edindiği varlığın niteliğine göre de “milkü’l-ayn”, “milkü’l-menfaa”, “milkü’d-deyn”, “milkü’l-habs ve’l-yed” gibi terimler geliştirilmiştir. İnsanlar arasındaki hukuki menfaatlerin karşı karşıya geldiği bazı durumlarda bu iki hak türü arasında tercih yapmak gerekebilmektedir. Bu tarz bir tercih durumunda aynî haklara, ihtiva ettiği yetkiler dikkate alınarak şahsî haklar karşısında bir tür öncelik tanınmıştır. Söz konusu önceliğin en belirgin şekilde görüldüğü yerlerden biri de kiraya verilen malın kira akdi devam ettiği sırada üçüncü kişilere devredilmesidir. Bu noktada İslam hukukunda kira akdinin kişiye kazandırdığı yetkiler Kara Avrupası hukuk sistemine göre farklılık arz eder. Makalede kiracının bu hakkının İslam hukukuna göre -Kara Avrupası hukuk sisteminden farklı olarak- aynî nitelikte kabul edildiği savunulmaktadır. Bunu temellendirmek için kiralanan malın kira müddeti içerisinde üçüncü şahıslara satılması, kiralanması veya gasp gibi haksız fiil şeklinde yorumlanabilecek yollarla intikal etmesi halinde fıkıh doktrininde kiracıya tanınan yetkiler incelenmiş İslam hukukunun bu hususlardaki özgün yaklaşımı klasik ve modern fıkıh eserleri dikkate alınarak, Türk hukukuyla da kıyaslamalar yapmak suretiyle ifade edilmiştir. Zusammenfassung In der vorliegenden Untersuchung wird eine Methodik zur Prognose des sportlichen Erfolgs eines Fußballunternehmens in der Bundesliga aufgezeigt. Um der begrenzten Prognostizierbarkeit des sportlichen Erfolgs Rechnung zu tragen, berücksichtigt das Prognosemodell neben der relativen Spielergehaltssumme, dem relativen Trainergehalt und der Vereinseffizienz explizit den Zufall als Einflussgröße. Das Prognosemodell wird dabei mit Hilfe einer empirischen Untersuchung der Spielzeiten 1996/1997 bis 2002/2003 validiert und spezifiziert. Die Prognose des sportlichen Erfolgs erfolgt mittels Monte-Carlo-Simuladon. Dementsprechend liefert das Prognosemodell keinen einzelnen Erwartungswert für die (...) Platzierung, sondern eine Wahrscheinlichkeitsverteilung. Hieraus lassen sich Wahrscheinlichkeiten für unterschiedliche sportliche Szenarien, wie z.B. den Gewinn der Deutschen Meisterschaft oder die Champions League-Qualifikation, ableiten. Die so ermittelte Wahrscheinlichkeitsverteilung der Platzierung ist wiederum geeignet, für die Einnahmenverteilung eines Fußballunternehmens ebenfalls Wahrscheinlichkeiten zu ermitteln. (shrink)

Dār al-Qurʾāns, which were among the madrasas in the Ottoman period and where qirāʾāt was taught, turned into the Qur'āns schools after the law on unity of education, enacted on March 3, 1924. That was the end of the institutional entity of qirāʾāt education in Turkey. Afterwards, a number of qirāʾāt teachers kept performing this education by their individual efforts. Among these teachers, Osman Nuri Taşkent who was the former head-imam of Nuruosmaniye Mosque in Istanbul was assigned as a Qurʾān (...) teacher in Adapazarı in 1936. This research aiming to address Taskent’s service as a public servant, his educational activities, and his role in the re-institutionalization of the qirāʾāt education is planned as a qualitative case study and carried out by document analysis and interview techniques. In conclusion, this study has demonstrated that (a) this school which aimed to be offered in Adapazarı was planned as qirāʾāt education school, (b) Taşkent was the responsible official teacher (c) 14 students graduated under his mentorship in Adapazarı, and (d) this institution was named as Dār al-Ḥuffāz of Adapazarı in his period. Moreover, it shows that after the leaving of Taşkent, this school maintained the education under the responsibility of Himmet Babalıoğlu who is one of the former students; however, the type of education changed and turned into a general Qur'āns chool.Summary: With the law of unified education which is a turning point in the history of Turkish education, all educational institutions were gathered under responsibility of the Ministry of Education. However, madrasas were closed approximately two months later, even though it was not included in the law. Along with the madrasas, Dār al-Qurrā that are the institutions performing education on the recitation, memorizing, and the principles ofreading the Qurʾān were also attempted to be closed with the similar understanding. However, the President of the Religious Affairs in this period opposed this attempt and these institutions turned into Qurʾān schools due to the insistences of the president that these institutions should maintain their education under the responsibility of the presidency of religious affairs. After this change, qirāʾāt education lost its institutional entity.Whether Dār al-Qurrās have been able to continue education since 1925 as Qurʾān schools is controversial. According to some researchers, the Qurʾān schools after this change were not closed as opposed to other religious institutions, imam hatip schools and Darülfünun Faculty of Theology, and continued their education. Another view is that these courses were officially opened for the first time in 1925, closed since 1929 with the alphabet revolution in 1928, but they restarted education in 1930 with the permission for limited locations in Anatolia and for some teachers in Istanbul. Another view is that the courses planned to be opened in ten places could not be activated due to some obstacles in 1925, but they could be opened after the closing of imam hatip schools after 1930.In some studies, it is stated that the qirāʾāt education, which lost its institutional existence with the conversion of Dār al-Qurrās to the Qurʾān schools, providing general Qurʾān education has been continued with individual efforts of some qirāʾāt teachers such as Serezli Ahmed Şükrü (d. 1932), Hamdi Efendi (d. 1939), Akrepoğlu Osman Nûrî Taşkent (d. 1942), Ömer Aköz (d. 1952), (Ayağıkesik) İsmail Hakkı Bayrı (d. 1972), Hasan Akkus (d. 1972) and Üsküdarlı Ali Efendi (d. 1976). In the same studies, it is also underlined that the science of qirāʾāt regained an institutional entity only after the attempts of Tayyar Altıkulaç in 1968, with the sending of the Diyanet to Aşıkkutlu, honorarily occupied with the science of qirāʾāt in Uğurlu town of Of. However, the fact that Osman Nuri Taşkent was appointed in 1936 as Qurʾān teacher in Adapazarı while he had been the chief-imam of the Istanbul Nuruosmaniye Mosque reveals that the efforts for the institutionalisation of the qirāʾāt education began much earlier.This research aiming to address Taskent’s service as a public servant, his educational activities, and his role in the re-institutionalization of the qirāʾāt education is planned as a qualitative case study. The main problem in the study is whether the appointment of Osman Nuri Taşkent, the chief-imam of the Istanbul Nuruosmaniye Mosque in 1936, as a Qurʾān teacher in Adapazarı is an attempt to establish an institution of qirāʾāt education in the early period of the republic, or not, and the some results are as follows:In the diploma that he awarded Himmet Babalıoğlu who one of his students in Adapazarı, Taşkent presented himself as assigned the teacher and tutor by Turkish Republic for those who want to memorize and learn the Qurʾān as well as to learn qirāʾāt according to books of Shātibiyya and Durra in Adapazarı. This statement shows that his main reason for the leaving Istanbul was qirāʾāt education. Before his appointment to Adapazarı in 1936, Taşkent was giving qirāʾāt education at the Nuruosmaniye Mosque. Accordingly, in his interview with Diyanet Magazine in 1989, Hızal who is one of previous students stated that he had received qirāʾāt education from Taşkent in Nuruosmaniye since the early 1930s. Moreover, in his ratification letter, he stated that Hızal got ratification for Taṣḥīḥ al-Ḥurūf on July 13th, 1933 and qirāʾāt on May 10th, 1935. These statements show that he was occupying with qirāʾāt education in Istanbul. In this case, it is not reasonable to assume that he was appointed in Adapazarı for general Qurʾān teaching.Some documents also clearly reveal that Taşkent went to Adapazarı for qirāʾāt education, and the education he provided there is about qirāʾāt. Six years after Taşkent left Adapazarı, the informative letter which the Adapazarı muftī of the period wrote to the Presidency of Religious Affairs is perhaps the most important document. According to this document, 14 students studied Taṣḥīḥ al-Ḥurūf in Adapazarı graduated under his mentorship. However, it should be immediately stated that “Taṣḥīḥ al-Ḥurūf” in this letter means qirāʾāt education in consideration of that Babalıoğlu and Hızal were among the 14 students. Because Babalıoğlu learned qirāʾāt all of them from Taşkent as in his diploma and Hızal received diploma of Taqrīb. Furthermore, Himmet Babalıoğlu and İsmail Uziş who were the students in Adapazarı submitted their petitions to ask the left position by Taşkent. These petitions are ones of the important documents proving that the process started with Taşkent in Adapazarı was qirāʾāt education. Accordingly, they both addressed their candidacy for Adapazarı Qurʾān teaching by emphasizing their qirāʾāt education and competence in this field.A clear answer may not be given to the question of "Is the appointment of Taşkent as a Qurʾān teacher in Adapazarı individually given to him or is an institution established there?" in the context of his departure. However, some correspondences show that this education was an institutional activity for his period. Then, when it is aimed to identify qirāʾāt education as an institution for its period, the title of “Dār al-Huffāz of Adapazarı” is used and Taşkent is described as “Adapazarı Qurʾān Teacher”. Additionally, as Adapazarı Qurʾān teaching had an institutional quality, one of his students, Himmet Babalıoğlu, was appointed to the relevant position after him. (shrink)

Standard language, which follows rules of dictionary and grammar, undergoes various changes when it is the subject of literature, especially poetry. These changes, called linguistic deviation, are due to the poet’s expression of his feelings and thoughts by forcing the possibilities of language. In this direction, language deviations can be defined as the dispositions where the author goes out of the standard language, as in the examples of changes in the pronunciation (ṣavt), form (ṣarf) or spelling (kitābet) of the words, (...) the derivation of new words that are not used in the language (irticāl) and the deterioration of the syntax (naḥv). According to many literary critics such as Ibn Hishām al-Ansārī (d. 761/1360) and ʿAbd al-Qādir al-Baghdādī (d. 1093/1682), this language used by Arab poets who were not influenced by foreign languages, namely the Cāhilī, Muḥaḍram and Islāmī poets (ḳudemâ), was acceptable and it is considered as ḍarūrātuş-şiʿriyye (poetry necessities). In this context, deviations that do not comply with the standard language are tried to be explained with dialect differences, different variants of the couplet or various interpretations. However, some scholars such as Ibn Fāris (d. 395/1004) and Abū al-Ḥasan al-Jurjānī (d. 392/1001-1002) argue that these usages are laḥn (linguistic mistakes). According to these names, it is not correct to explain the poets’ use, which are contrary to the standard language rules, with excessive interpretations (takalluf). Assuming that linguistic deviations are laḥn, they cannot represent a superiority in terms of literary value, but when considered as a necessity, they represent a superiority within the framework of certain criteria. But any specific criteria have been determined before about which linguistic deviations represent the superiority. Therefore, in our study, the theories put forward about the accuracy of linguistic deviations that exceed the standard language rules will be examined and the necessary criteria for them to represent a superiority will be determined. In this direction, the difference in meaning and form that this deviation adds to the expression becomes important. If the language deviation, which is contrary to the standard sentence structure, does not comply with the language rules in any aspect and does not add any superiority to the poem in terms of meaning and form, it does not seem possible for such uses to represent a more fluent and persuasive language (al-Balāgha). However, the language deviation reveals a new meaning or form that is not found in the standard expression, and if this usage complies with the standard language rules, it represents a more eloquently language. The degree of violation of the purity and perfection of language (faṣāḥa) of a statement is related to the violation of qiyās (analogy?) and grammatical incongruity mentioned in the rhetoric books. The contravention of common language rules of these uses, which are not considered faṣīḥ, varies. As a matter of fact, some of these were seen as minor mistakes that could be ignored, while others were considered as major mistakes. For this purpose, a conceptual framework about linguistic deviations is drawn at the introduction of the article, and the literary theories on the subject are examined in the first chapter. In the second part, it is argued that linguistic deviations represent a superiority depending on certain criteria by giving examples from the poems of the period of Jāhilīyah. (shrink)

In Turkey, where the philosophy of religion is still a relatively new academic field, there are different approaches regarding the fundamental principles that should guide its development. It has been claimed that to conduct a Muslim philosophy of religion, it is necessary to stay away from the concepts that are the product of the intellectual pursuit of Western thought. This claim, which is put forward by Hasan Er, is justified by the thought that some of the basic concepts that (...) emerged in the philosophy of religion in the West are a product of the West’s confrontation with the Christian medieval thought, and therefore, they do not comply with the basic Islamic principles. The judgment that the philosophy of religion in the West arose based on Christianity seems acceptable. From this point of view, since the belief system of Christianity is very different from Islam, it has been argued that the concepts used in the philosophy of religion in the West should not be associated with Islam. Three concepts are especially claimed to be avoided here. These are deism, atheism, and theism. This claim triggers an important debate in philosophy of religion. This is whether there can be a philosophy of religion specific to a particular religion. In this study, the claims briefly described above will be discussed. While doing this, the claims put forward will be subjected to an analytical evaluation. As a result, it will be discussed that the concepts should be considered not only with the meanings they first appeared but also with the meanings they acquired in the process. On the other hand, if it is not possible to make a Muslim philosophy of religion with Western concepts, then it will be taken into consideration that it is necessary to ask “How Muslim is the philosophy of religion?”. Antalya, which is today’s attraction center with its historical and natural beauties, was described as “a city like heaven” since ancient times. This city hosted many civilisations and states until the 13th century and became an important seaport after The Seljuks took over the region. The Seljuks applied civilization and urbanization policy also in Antalya, like other regions they ruled. The mosques, madrasahs (Islamıc theology institutions), schools, baths, caravansearis (hostels), hospices, and water cisterns in this period changed the structure of (...) the city and paved the way for improvements of public life. During the Ottomans some of these social institutions were kept active while the others no longer served to the public. However, with the construction of new social institutions, urbanization was resumed. The madrasas were generally built near or adjacent to the mosques, and had a significant role in developing the society and cultural structure. Although the madrasas in Antalya were mainly the institutions that maintain the education system, the research on these madrasas mostly focuses on their architectural features. The majority of these madrasas that are not comprehensively studied. Therefore, the functioning structures and the problems of Antalya Madrasas (Antalya, Korkuteli and Elmalı), which are reflected in the archive documents between the 17th and 20th centuries and also both individuals and institutions that had influence on these madrasas are going to be investigated in this study. Thus, this paper will shed more light on Antalya Madrasas.Summary: Antalya city, which was completely under the Seljuk sovereignty during the reign of Sultan Alaeddin Keykubat I (1219-1236), was named as Alâiyye dedicated to the Sultan's name and became an important port city of the Seljuk State after then. In the process of the fall of the Seljuk State and the beginning of the Emirates (Beylikler) period, the city became a land of Teke-Oğulları, a part of a Hamid-oğulları, and in 1390 the city became an Ottoman city after the struggle of Yıldırım Bayazid with Teke-oğuları. Antalya was home to the madrasahs, one of the formal education institutions during both the Seljuk and the Ottoman Empire. The madrasahs were built next to the mosque or in a detached area built by sometimes administrators or statesmen, sometimes by members of the dynasty or by the citizens who were wealthy. In Antalya, both single floor and second floor madrasahs were built. This study based on the documents from Prime Ministry Ottoman Archive, the travel books of İbn Bibi and Evliya Çelebi, the works on Antalya Madrasahs to be determine the madrasah in the districts of Antalya as Korkuteli and Elmalı. In addition to the Seljuk madrasahs such as Imaret Madrasah, Atabey Armagan Madrasah and Karatay Madrasah, there are also some madrasahs belonging to the Ottoman period, in Antalya. As a matter of fact, the madrasahs increased in number in the period of the Ottoman. Antalya madrasahs which are reflected in archival documents for any reason are as follows: “Süleyman Madrasah” located in Hatip Süleyman Street, “Madrasah built by Haci Mahmed” located in Elmali Street, “Hacı Abbaszâde Hacı Süleyman Madrasah” in Süleyman Street, “İsmail Efendi Madrasah” in Tahtapazarı Kızılsaray Street, Kasab Hacı Ahmed Madrasah, Hacı Cafer Ağa Madrasah, Murad Ağa Madrasah, Esir Hacı Ali Madrasah, Hacı Hasan Madrasah,“Madrasah built by Hasan Efendi” in Keçiyalar Street, in the Kadılar Street of Gediz County “Madrasah built by Yusuf Efendi”, “Madrasah built by Hızır Efendi” in Cami-i atik Street, Murat Pasha Madrasah, “Sefer Ağa Madrasah” located outside the city wall, “Büyülü Minaret Madrasah, Hatuniye Madrasah, Sheik Sinan Camii Madrasah located outside the city Wall, In addition to these madrasahs mentioned in some studies in Antalya, it is also stated that there are madrasahs such as Müsellim Madrasah, Kesik Minaret Madrasah, Karakas Madrasah, Varsakli Mehmet Efendi Madrasah, Meydan Madrasah, Surmeli Madrasah, Canmülk Madrasah, Ahi Kız Madrasah, Hacı Naim Efendi Madrasah, Susam Madrasah, Çömlekçi Madrasah, Değirmenönü Madrasah, Ak Mescid Madrasah, Âşık Doğan Madrasah and Çukur Madrasah.According to archive documents, in the sub-district of Antalya, which is used as a plateau or plateau area, some madrasahs were recorded as follows: Pınarbaşı Madrasah, Hızır Efendi Madrasah, Mustafa Efendi Madrasah, Emir Sinaneddin Madrasah, Hacı Menlü (Mevlüt) oğlu Ömer Medrese, Abu Bakr Agha Madrasah, Koca Hafız Medrese, Hacı Mollaoğlu El-Hac Ömer Madrasah, Sheikh İsmail Efendi Madrasah. However, Süleyman Fikri Erten, who works on Antalya, stated that the number of madrasahs is eight as: Haci Ahmet Madrasah of Kalkanlı, Sultan Hatun Madrasah, Koparanzade Hacı Hüseyin Madrasah, Karabayırlı Hacı Hüseyin Madrasah, Kaşlı Ali Efendi Madrasah, Hacı Hüseyin Madrasah, Şalaka Ahmet Madrasah and Oyunyeri Madrasah.The madrasahs built in Elmalı, another distict of Antalya, were as follows: Ketenci Ömer Paşa Madrasah, Esbak Mir-i Ahur Hacı Mehmet Bey Madrasah, Haydar Baba Madrasah, Arifî Ahmed Paşa Madrasah, Hüseyin Efendi Madrasah, Debbağ Baba Madrasah, Şeyh Ümmi Sinan Madrasah, Babazade Hacı Abdurrahman Madrasah, Hacı Şeyh Efendi Madrasah, Mustafa Efendi Madrasah, Hasan Efendi Madrasah, Salih Efendi Madrasah, Halil Efendi Madrasah, Çankırlı Madrasah, Osman Efendi Madrasah and “Mehmet Efendi Madrasah in Örtekiz village”. In addition, two madrasahs, except from these, were also found in the archive documents.A madrasah was built almost at every Street of Antalya and the madrasahs were usually named by the name of their builders. Madrasah students were provided with a certain amount of scholarship to continue their education according to the level of the education in the madrasahs and the level of the courses taught, salaries of the scholars, the status of the builder of the madrasah. The scholars who worked in the madrasahs worked with a document called berat-i sharif and in the case of the disappearance of this document a new berat-i sharif would be prepared by the Shaykh al-Islami. Scholars working without this document were also determined. In the scholar appointments foundation, board of trustees, müfti, and the city regents were very influential. There were also some appointments resulted from death, promotion besides leaving job with their own will. There were some problems with the appointments in Antalya and the foundation revenues to which the madrasah was attached were delivered to certain individuals until these problems were resolved.In madrasahs of Antalya, science was given a great importance and all kinds of monetary issues were tired to be eliminated with donations given to both scholars and students. However, it is observed that madrasahs were involved in some events in Antalya. As a matter of fact, among those who participated in the Şah Kulu Rebellion that took place in 1510-1511, there were also madrasah students and education training had therefore been disrupted for a long time. it is known that the state sent orders to the judges (qadi) in the region consecutively in order to prevent the rebellion. Also during this period some madrasahs were used as the activity center of armed students or people who disguised them.One of the issues that negates the education and training in the madrasahs in Antalya is that in 1890 the immigrants started to be hosted in Antalya and the guests visiting were accommodated in madrasahs as there were no other available places. This situation had been continued for a long time and even telegrams have been sent about the students living on the sidewalks.Another important issue that disrupts education was epidemic diseases. It was reported that too many people died in the district of Istanoz because of smallpox, there was no doctor and the health personnel should go to the region urgently. Despite all the problems experienced in madrasahs, they continued their activities in Antalya and while continuing their activities under the control of foundations in 1826, with the establishment of the Ministry of Foundations, they were connected to this institution. The need for continuing provision of beneficial experimental interventions after research is concluded remains a controversial topic in bioethics for research. Based on the principle of beneficence, justice as reciprocity, concerns about exploitation and fair benefits, participants should be able to have continuing access to benefits beyond the research period. However, there is no consensus about whether or not post-trial provision of beneficial interventions should be mandatory for participants from developing countries. This paper summarises recommendations from international and national guidelines. (...) Ethical principles and practical issues relating to post-trial provision are also discussed. In conclusion, post-trial provision is not necessary in all situations and a set of criteria are proposed to identify the situations that beneficial interventions should be provided beyond the research period. However, mandatory post-trial supply of beneficial experimental interventions should be assured for those who still need and are able to benefit from them but have no alternative access. Mandatory provision is based on universal bioethical principles such as beneficence and justice. Furthermore, difficulties associated with implementation of post-trial provision are not unmanageable. Careful advanced planning and a comprehensive partnership among relevant parties would be very helpful in solving these difficulties in practice, which therefore should not be taken as an excuse to escape post-trial responsibility. Türk ve İslam tarihinin kırılma noktalarından birisi 1040 yılında Selçuklular ile Gazneliler arasında cereyan eden Dandanakan Savaşı’dır. Savaşın ardından Selçuklular hızlı bir yükselişle özellikle Sünnî İslam coğrafyasında etkin ve belirleyici güç haline gelmiştir. Göçebe kültürden gelen ve bir oba hüviyetinde iken çok kısa bir sürede önlenemez bir şekilde hâkimiyet alanını Türkistan coğrafyasından Anadolu içlerine kadar genişleten Büyük Selçuklu Devleti, kurumsal olarak da olgunlaşmaya başlamıştır. Bu noktada hem merkezi yönetimde hem de vilayetlerde ortaya çıkan yetişmiş eleman ihtiyacını birçoğu daha önce Gazneli (...) devlet teşkilatında görev yapmış Fars asıllı devlet adamları karşılamıştır. Bu isimlerden birisi de ileride Nizâmülmülk adıyla şöhret bulacak ve namı isminin önüne geçecek olan Hasan b. Alî b. İshâk et-Tûsî’dir. Nizâmülmülk, devlet gücünün askeri alanda elde edilen zaferlere endekslendiği bir dönemde askerî, idarî, ilmî ve ekonomik alanda attığı adımlar ve aldığı tedbirlerle Büyük Selçuklu Devleti’nin kurumsallaşmasında son derece etkin bir isim olmuştur. Bu etkinlik neticesinde hem halk hem de devlet adamları nezdinde saygın bir yer edinmiştir. Bu çalışma çerçevesinde Nizâmülmülk’ün devlet bürokrasisi içerisindeki konumuna, hükümdar ve hanedan üyeleri ile olan ilişkilerine ve vezirlik sürecinde attığı adımların Selçuklu tarihine yansımalarına değinilecektir. Özet: Devlet kademesinde görev almaya Gazneliler Devleti’nin Horasan Valisi Ebü’l-Fazl Sûrî’nin yanında başlayan Nizâmülmülk, Horasan Bölgesi’nin Selçukluların kontrolüne geçmesiyle birlikte hizmetlerine Selçuklu Devleti’nde devam etmiştir. Çağrı Bey’in hizmetinde rüştünü ispat eden Nizâmülmülk, Çağrı Bey’in en güvendiği isimlerden biri haline gelmiştir. Öyle ki, Çağrı Bey ileride önce Horasan’ın sonrasında tüm Selçuklu yurdunun yönetimini üstlenecek olan oğlu Alparslan’ı Nizâmülmülk’e emanet etmiş, oğluna da Nizâmülmülk’ü bir baba olarak kabul etmesini, ona muhalefet etmemesini öğütlemiştir. Alparslan, babasının tavsiyeleri ve üvey kardeşi Süleyman ile giriştiği taht mücadelesinde gösterdiği yararlılık münasebetiyle devletin en önemli idari görevi olan vezirlik makamını Nizâmülmülk’e tevdi etmiştir. Bu dönemden itibaren vefatına kadar, yaklaşık 30 yıl kesintisiz bir süreyle Büyük Selçuklu Devleti’nin vezirliğini yapmış ve V./XI. yy.’ın ikinci yarısından itibaren Büyük Selçuklu siyasetinin en etkin figürü haline gelmiştir. Melikşah’ın tahta geçebilmesinin Nizâmülmülk ile ilişkilendirilmesi, onun döneminde elde edilen başarıların ve devlet sisteminin düzenlenmesi, şehirlerin imarı, ekonominin güçlenmesi gibi ülke içerisinde yaşanan olumlu gelişmelerin Nizâmülmülk’ün marifetiyle gerçekleştirildiğinin dillendirilmesi, Tanrı tarafından yeryüzünü yönetmek ve inşa etmek için seçildiği düşünülen bir sultan varken bir vezirin devlet için nimet olarak gösterilmesi sultanın vezirine bakışını etkilemiştir. Bu noktada üzerinde durulması gereken hususlardan birisi de Nizâmülmülk’ün kendisini nasıl gördüğü ve devlet içerisinde kendini nerede konumlandırdığıdır. Nizâmülmülk’ün Sultan Melikşah’a verdiği bir cevapta devletin geldiği noktayı ve sultanın mevcudiyetini kendi varlığıyla eşleştirmesi, tarihinin gördüğü en yetenekli vezirlerden biri olan Nizâmülmülk’ün özgüveninin son derece yüksek ve kendisini kudret sahibi olarak gördüğüne işaret etmektedir. Bu anlamlandırma halk nezdinde herhangi bir kutsiyeti bulunmayan vezirlik makamındaki bir kişinin, toplum nezdinde Allah tarafından seçildiğine inanılan kutlu kişiye meydan okutan gücü kendisinde hissetmesinin kaynağını sorgulatmaktadır. Aranan cevap Nizâmülmülk’ün vezirlik sürecinin çeşitli başlıklar altında ve bu başlıklara dair verilecek örneklerle incelenmesi neticesinde onun devletin iç işleyişine etkisinin tespitinde ve farklı kesimlerle kurduğu ilişkide saklıdır. Nizâmülmülk, Selçuklu tahtına karşı sıkı bir bağlılık göstermiştir. Bu bağlılığını lüzumu halinde savaş meydanında göğüs göğüse çarpışarak sergilemiş, gerekli olduğunda kıvrak zekâsı ile sorunları devlet için tehlikeli boyuta gelmeden çözmüş, siyasi öngörüsü ile aldığı tedbirler sayesinde devletin büyümesine katkı sağlamıştır. Onun bu sadakati ve samimiyeti, Selçuklu sultanları tarafından karşılık bırakılmamış, Alparslan vezirinin fikirlerine büyük önem verip tercihlerini bu doğrultuda şekillendirirken, aleyhine söylenen sözlerin hiçbirine kulak asmamıştır. Melikşah da, bir anlamda kendisine Selçuklu tahtını veren Nizâmülmülk’e gerekli hürmeti göstererek bütün devlet işlerinin yürütülmesini ona tevdi etmiş ve kendisini bir “baba” gibi gördüğünü ifade etmiştir. İlaveten Selçuklu tarihinde bir ilk olmak üzere Melikşah, Nizâmülmülk’e atabeg (el-emîrü’l-vâlid) unvanını vermiştir. Melikşah, Büyük Selçuklu tahtındaki ilk yıllarını, gençliğin etkisiyle, polo oynayıp, büyük av partileri düzenlemekle geçirmiş ve bundan dolayı devlet içerisinde bütün güç Nizâmülmülk’ün eline geçmiştir. Ortaya çıkan bu durum da “ülke resmen ve ismen sultanın olmakla birlikte gerçekte ‘Nizam’ına kavuştu.” ifadesiyle açıklanmıştır. Ayrıca Melikşah’ın saltanatı döneminde elde edilen askerî, siyasî ve ekonomik başarılar Nizâmülmülk’ün yeteneği ve devlet işlerinde attığı adımlara bağlanmıştır. Nizâmülmülk, hanedan ile kurduğu ilişkinin yanı sıra devlet kademesinde görev alan farklı zümrelerle de güven üzerine dayalı yakın bir ilişki biçimi geliştirmiştir. Örneğin, Nizâmülmülk’ün katıldığı askerî seferlerde bir nefer gibi askerlerin içerisinde savaşa katılması ordu içerisinde kendisine saygı duyulmasına yol açmıştır. Ayrıca, Melikşah ile Kirman Hâkimi Kavurd Bey arasındaki taht mücadelesinde Melikşah’ın safında yer almakla birlikte Kavurd Bey’i destekleyen bazı isimlerin yazdıkları destek mektuplarının ortaya çıkmasına engel olarak hem emirlerin korkularını yatıştırırmış hem de itibarını artırmıştır. Nizâmülmülk’ün yakın ilişki içerisinde olduğu bir diğer grup ilmiye sınıfı olmuştur. Bilge vezir, Tuğrul Bey döneminde Amidülmülk Kündürî tarafından takibata uğrayan ve baskılara maruz kalan ilim adamlarının yurtlarına dönebilmelerine imkân sağlamıştır. Bu ilim adamları da yurtlarına dönüşlerini sağlayan isme zihinlerinde ve gönüllerinde her zaman özel bir yer ayırmışlardır. Birçok âlimin çalışmalarını Nizâmülmülk’e ithaf etmesi, diğer saiklerle birlikte, bunun bir göstergesidir. Nizâmülmülk bir adım daha atarak, Sultan Alparslan ve Melikşah’ın müsaadeleriyle, bu ilim adamları için hâkim olunan coğrafyanın her tarafında ilimle iştigal edebilecekleri medreseler inşa etmiştir. Nizâmülmülk’ün adına nispetle Nizamiye Medreseleri olarak isimlendirilen bu medreselerde hem eğitim-öğretim kadrosuna hem de öğrenim süresi boyunca ve de mezun olduktan sonra öğrencilere sunulan imkânlar, insanların medreselere olan ilgisini arttırıyordu. Medreseler eliyle bir taraftan önceki dönemde yerlerinden edilen ve baskıya maruz kalan ilim adamlarına bir borç ödenip iade-i itibar sağlanırken diğer taraftan da Büyük Selçuklu Devleti’nin idari ve adli sisteminin ihtiyaç duyduğu yetişmiş insan gücü inşa edilmiştir. Nizâmülmülk, toplum lehine attığı adımlar ve sorunların çözümüne verdiği önem ile halkın desteğini sağlamıştır. Öyle ki insanların hayatları boyunca ona minnettar kaldığı vurgulanmıştır. Nizâmülmülk halkın sorunlarının çözümüne önem göstermiş ve onlarla yakından ilgilenmiştir. Nizâmülmülk’ün verdiği güven duygusu halkın hoşuna gitmiş ve toplum içerisinde kabul görmesine vesile olmuştur. Nizâmülmülk’ün bir diğer hasleti de fakirlere sofrasını açmasıdır. Böylece onlarla diyalog kurmuş ve gönüllerini kazanmıştır. Her yönüyle eksiksiz bir devlet adamı olan Nizâmülmülk, toplumun her türlü ihtiyacının çözümünü düşünmüş ve bu yönde adımlar atmıştır. Nizâmülmülk’ün toplumun her kesimi ile kurduğu samimi ve yakın ilişki o kadar büyük bir takdir ve beğeni toplamıştır ki bu durum Nizâmülmülk’ün toplum nezdinde sultan itibarı görmesine sebep olmuştur. İlaveten Selçuklu coğrafyasının her yerinden ve toplumun her kesiminden insanın kendisine yönelmesi hasebiyle Kâbe’ye benzetilmiştir. Nizâmülmülk, devlet kademesinde görev alan aile bireyleri, ilişki içerisinde olduğu âlimler, kendi ordusu ve emirleri ile bir güç odağı haline gelmiştir. Bunun sonucunda Nizâmülmülk, 11. yüzyılın son çeyreğinde rakipsiz bir şekilde Büyük Selçuklu siyasetinin en etkin figürü, Selçuklu yönetimini ve politikalarını belirleyen isim ve Selçuklu tarihinin en önemli olaylarında karar mercii olmuş ve sonuçta Selçuklu tarihine damga vurmuştur. İbnü’l-Esîr, Fatımî veziri Bedr el-Cemalî’nin kendisi için kullandığı sayısız lakabı kaydettikten sonra sadece Mısır’a hâkim olan bir devletin veziri bu kadar lakap kullanıyorsa Nizâmülmülk’ün “ilah”lık iddiasında bulunması gerekirdi diyerek hem Selçuklunun azametini hem de Selçuklu devletinde Nizâmülmülk’ün yerini göstermektedir. Mezheplerin teşekkül etmeye başladığı ilk dönemlerden itibaren istihsanın bir istidlal yöntemi olup olmadığı tartışılagelmiştir. Bu tartışmaların temelinde kavramsallaşma sürecini henüz tamamlamamış olan istihsan teriminin çağrıştırdığı keyfiliğin/sübjektivitenin etkisi çok fazladır. Bu yüzden istihsanı bir yöntem olarak benimseyenler, ağır ithamlara maruz kalmışlardır. İstihsanı benimseyenlerin başında Hanefî hukukçular gelmektedir. Öyle ki istihsan yöntemi Hanefî mezhebiyle anılır hale gelmiştir. Bununla birlikte mezhebin önde gelen temsilcilerinden biri olan ve kıyas metodunu kullanmasıyla ön plana çıkan Züfer b. Hüzeyl’in istihsana yaklaşımıyla ilgili iki farklı yaklaşım tespitedilmiştir. Yaptığımız (...) araştırma ve inceleme neticesinde her iki tespitinde isabetli olmadığını; Züfer b. Hüzeyl’inkıyas yapmadaki becerisinin yanı sıra istihsana müracaatta sonuna kadar kıyas taraftarı olduğunu; ancak kıyasın meselelere çözüm üretmede yetersiz kaldığı ya da doğru sonuç vermediği durumlarda ise ızdırârın da bir gereği olarak meseleyi hükümsüz bırakmama adına istihsana müracaat ettiği görülmektedir. Sonuç olarak Züfer b. Hüzeyl’in genel hatlarıyla Hanefî usulüne bağlı kalmakla birlikte istihsanı bir istidlâl yöntemi olarak kullanma hususunda çerçeveyi oldukça daralttığını; kıyasa başvurma konusunda ise sınırları mümkün olduğunca geniş tuttuğunu söylemek mümkündür. İctihad hürriyeti ve hukûkî zenginlik açısından oldukça önemli olan Hanefi mezhebindeki mezhep içi ihtilaflar, hukûkî istikrar ve emniyeti tehdit etme potansiyeli taşımakta ve ayrıca ihtilaflı meselelerde hüküm veya fetva verecek fakihlerin işini zorlaştırmaktadır. Bu nedenle mezhep içerisindeki ihtilaflı meselelerde râcih görüşü tespit etmek, diğer bir ifadeyle mezhep içi tercih, zorunlu bir ihtiyaçtır. Mezhep içi tercih, “muayyen bir mesele ile ilgili mezhepteki muhtelif kavil veya rivayetlerden daha ağır basanı, üstün olanı belirlemek” şeklinde tarif edilebilir. Tarihi süreçte bu ihtiyacı karşılamak için muhtasar ve fetva kitapları gibi farklı telif türleri; esahh-ı akvâl ve maʻrûzât gibi farklı uygulamalar ortaya çıkmıştır. Bu ihtiyacı gidermeyi hedefleyen uygulamalardan biri de Osmanlı Devleti’nin son dönemindeki kanunlaştırmalardır. Fıkha dayalı kanunlaştırmanın ilk örneği olan Mecelle-i Ahkâm-ı Adliyye ile mezhep içi tercih arasındaki ilişki ve bu bağlamda Mecelle hazırlanırken, mezhep içi tercihte nasıl bir usûl izlendiği; râcih görüşe ne oranda uyulduğu; Mecelleʼde yer alan râcih görüşe aykırı kanun maddeleri ve bunların gerekçeleri; ihtilaflı bütün konularda düzenleneme yapılıp yapılmadığı ve râcih görüşleri belirleme ihtiyacının ne kadar giderildiği, incelenmesi gereken konulardır. Mecelle-i Ahkâm-ı Adliyye gibi bir kanun metnine ihtiyaç duyulmasının temel nedenlerinden birisi, Hanefî mezhebinde mezhep içi ihtilafların çokluğudur. Buna bağlı olarak Mecelleʼnin hedefi râcih görüşler içeren oluşan bir kanun hazırlamaktır. Mecelle’nin esbâb-ı mûcibeleri mezhep içi tercih açısından incelendiğinde, esbâb-ı mûcibelerin iki temel işlevi olduğu görülür. Bunlardan ilki, kanunun büyük oranda mezhepteki râcih görüşlere uygun olarak hazırlandığını vurgulamaktır. Öyle ki, Mecelle’nin ilk on kitabının esbâb-ı mûcibelerinde bu husus mutlaka ifade edilmektedir. Esbâb-ı mûcibelerin diğer işlevi ise niçin bazı maddelerde râcih görüşe riayet edilmediğini gerekçelendirmektir. Esbâb-ı mûcibelerde on iki maddenin râcih olmayan görüş doğrultusunda hazırlandığı belirtilmektedir. Mecelleʼnin 1851 maddeden oluştuğu göz önünde tutulduğunda Mecelleʼnin muhtevasında râcih görüşlerin ne kadar etkili olduğu daha iyi anlaşılacaktır. Esasen devrin özelliği de bunu zorunlu kılmaktadır. Zira Kitâbüʼl-Havâlenin 692. maddesinde Züferʼin râcih olmayan görüşünün tercih edilmesi, başta Şeyhülislam Hasan Fehmi Efendi olmak üzere bazı çevrelerin tepkisine neden olmuş ve bu sebeple Ahmet Cevdet Paşa Divân-ı Ahkâm-ı Adliyye nâzırlığından ve Mecelle Komisyonu başkanlığından azledilmiştir. Râcih görüşe aykırı maddelerin esbâb-ı mûcibeleri incelendiğinde, bu yöndeki tercihlerde maslahat ve örfün belirleyici olduğu görülmektedir. Ayrıca bazı fakihlerin tercihlerinin de bir tercih sebebi olarak zikredildiği görülmektedir. Hanefi kaynaklarda en sık karşılaşılan tercih sebebi naslara uygunluktur. Buna karşın Mecelleʼde sefîhin hacri konusu dışında, naslara uygunluğun bir tercih sebebi olarak işletilmemesi dikkat çekicidir. Mecelle Komisyonunun bazı tercihlerine diğer kurumlarca müdahale edilmiştir. Komisyonca hazırlanan kitaplar hem Meclis-i Vükelâ hem de Meşîhat tarafından incelenmiş ve bu esnada bazı tashihlere konu olmuştur. İşte râcih olmayan görüş esas alınarak hazırlanan iki maddeye Meclis-i Vükelâ tarafından müdahale edilmiştir. Bunların birincisi hakk-ı mürur ve hakk-ı şirbin müstakil olarak satımının cevazını savunan Belh Meşâyihinin görüşü doğrultusunda yazılan 216. madde, ikincisi ise ecîr-i müşterekin tazmin sorumluluğunu düzenleyen 611. maddedir. Mecelle’nin ilk ve en hacimli kitabı olan Kitâbüʼl-Büyûʻun muhtevası mezhep içi tercih açısından incelendiğinde, ihtilaflı konularda genelde mezhepteki râcih görüşün esas alındığı görülmektedir. Kitâbüʼl-Büyûʻun esbâb-ı mûcibesinde, dört meselenin râcih olmayan görüş esas alınarak hazırlandığı ifade edilmekte ve bu tercihler örf ve maslahatla gerekçelendirilmektedir. Ancak Kitâbüʼl-Büyûʻdaki râcih görüşe aykırı maddeler bunlarla sınırlı değildir. Bizim araştırmamıza göre bunlara ilaveten üç madde daha râcih olmayan görüş tercih edilerek hazırlanmıştır. Bunlar beyʻ biʼl-vefânın menkullerde cevazına dair 118. madde, gabn-i fâhişin tanımı hakkındaki 165. madde ve şart muhayyerliğinin hükmü ile ilgili 309. maddedir. Bu üç madde, Mecelleʼdeki râcih görüşe aykırı düzenlemelerin sadece esbâb-ı mûcibelerde açıklananlardan ibaret olmadığını göstermektedir ve bu durum Mecelle hazırlanırken izlenen usûle aykırıdır. Hanefi mezhebindeki bazı ihtilaflı meselelerde hangi görüşün râcih olduğu konusunda tercih ehli fakihler ihtilaf etmişlerdir. Bu meselelerde Mecelleʼde düzenleme yapılırken nasıl bir yol izlendiği açıklanmamıştır. Bu meseleler incelendiğinde çoğunluk tarafından tercih edilme, kolaylığı temin etme ve bazı fakihler tarafından tercih edilme gibi hususların etkili olduğu söylenebilir. Mecelleʼdeki tercihler sadece şerʻî hükümler arasında gerçekleşmemiştir. Buna ilaveten tanımlar ve tanımlarda yer alan kayıtlar da tercihe konu olmuştur. Bu kapsamda Kitâbüʼl-Büyûʻdaki beyʻ akdi, mevkûf akid ve gabn-i fâhişin tanımına ilişkin tercihler örnek olarak zikredilebilir. Hanefi mezhebin içerisindeki ihtilaflı bazı meseleler Mecelleʼde düzenlenmemiştir. İhtilaflı meselelerin çokluğu ve dolayısıyla bütün bunları kapsayan bir kanun hazırlamanın zorluğu dikkate alındığında bu durum doğaldır. Ayrıca bu meselelerden bazıları sık gerçekleşmediği ve lüzumlu görülmediği için Mecelleʼde düzenlenmemiş olabilir. Ancak düzenleme yapılmayan ihtilaflı meselelerin tamamını bu sebeplerle izah etmek mümkün değildir. Zira yasal düzenleme yapılmayan ihtilaflı meselelerin bazıları temel, görece önemli meselelerdir ve muhtasarlarda yer almaktadır. Bu durum Mecelle hazırlanırken, ihtilaflı bazı meselelerde tercih yapmak yerine bu meselelere ilişkin düzenleme yapmama metodunun benimsendiğini göstermektedir. İhtilaftan ârî bir kanun metni oluşturmanın bir yolu olarak da bu usûlün benimsendiği söylenebilir. Böylece bu meselelerde râcih görüşü tespit etme işi hâkimlere bırakılmıştır. Bu durum Mecelleʼnin hedefi olan râcih görüşleri tespit etme ihtiyacını gidermeye uygunluk arz etmemektedir. Ancak bu durum bütün meseleleri kuşatan bir kanun yapmanın güçlüğünün bir sonucudur. Objectives: To explore how subjects in a placebo-controlled vitamin A supplementation trial among Ghanaian women aged 15–45 years perceive the trial and whether they know that not all trial capsules are the same, and to identify factors associated with this knowledge.Methods: 60 semistructured interviews and 12 focus groups were conducted to explore subjects’ perceptions of the trial. Steps were taken to address areas of low comprehension, including retraining fieldworkers. 1971 trial subjects were randomly selected for a survey measuring their knowledge (...) that not all trial capsules are the same. The subjects’ fieldworkers were also interviewed about their characteristics and trial knowledge. Factors associated with knowledge were explored using multi-level modeling.Results: Although subjects knew they were taking part in research, most thought they were receiving an active and beneficial medication. Variables associated with knowledge were education and district of residence. Radio broadcasts benefited those with some schooling. Fieldworkers’ characteristics were not associated with subjects’ knowledge.Conclusions: Research and debate on new or improved consent procedures are urgently required, particularly for subjects with little education. Purpose. The main purpose of this paper is to consider the methodological peculiarities in the formation and interpretation of war and peace, in the context of the spiritual rethinking by humanity and the nature of social phenomena, among which a special place is occupied by the political and legal phenomena of the modern world. This involves solving the following tasks: firstly, to reveal the meaning of modern approaches in understanding the features of religious fundamentalism, and, secondly, to reconstruct the dynamics (...) of transformations in representations of war and peace, in the context of the spiritual practices of the present. Theoretical basis. The author's analysis is based on the systematic reconstruction of modern theoretical models of understanding religious fundamentalism and its connection with the subject of modern anthropological research. The resulted fact that the taxonomy of different types of religious fundamentalism includes more political, legal and economic markers does not provide an answer to the question of what the qualitative influence of the fundamentalist ideas is on the spiritual component of a person's life. Appealing to the problem of religious fundamentalism, in the context of rethinking the phenomena of war and peace, is associated with the actualization of these phenomena in the communicational, media and ideological spheres. That is why, in the context of this analysis, we take into account the main modern approaches in the provisions of religious traditions. These articulate the problems of threat to the global world in the context of actualization and return of the religious factor into the everyday life of a person, including through politics. Originality. The author proves that when analyzing the religious aspect in the reinterpretation of ideas about war and peace, it is necessary to consider, as a doctrinal component, certain types of religious belief doctrines, as well as the individual psychological peculiarities of man. These peculiarities, which are manifested in different types of beliefs, can be verified by the clues in the analysis of religious practices, which represent the meaningful components of the religious doctrine. Conclusions. The reasons for forming ideas about war and peace in theistic religions are a number of provisions related to the nature of the world and of man. They are the result of the manifestation of the act of the Supernatural Essence. In the tradition of rethinking the vocation of man in the context of fundamentalist discourse, these ideas acquire the status of spiritually determined and politically achievable goals. These are conceived in connection with the establishment of the Divine Plan, and they overcome the gap between the material world and the ideal world order. (shrink)

Qaside-i Khamriyya (meaning Wine Eulogy) of sufi poet Ibn-i Fārıḍ, in which he explained divine love through the metaphor of wine, attracted great attention in Islamic world and was translated into Arabic, Persian and Turkish. Scholars such as Davud-i Qayseri (d. 751 AH/1350 AD), Kemal Pashazāde (d. 940 AH/1534 AD), Abdulghani an-Nablusi (d. 1143 AH/1731 AD), Ibn Acibe (d. 1224 AH/1809 AD) explained this eulogy in Arabic, while poets such as Ali b. Shihābiddin al-Hamadāni (d. 786 AH/1385 AD), Molla Cāmi (...) (d. 898 AH/1492 AD), Idris-i Bitlisi (d. 926 AH/1520 AD) wrote commentaries in Persian. On the other hand, authors such as Abdussalam b. Numan b. Khalil (d. 1000 AH/1592 AD [?]), Ismail Anqaravi (d. 1041 AH/1631 AD), Abdulmacid-i Sivasi (d. 1049 AH/1639 AD), Qara Musṭafa Khulūsi (d. 1344 AH/1926 AD), Meḥmed Naẓım (d. 1345 AH/1926 AD) and Ṭahir al-Mavlavi (d. 1371 AH/1951 AD) translated the eulogy into Turkish. One of the authors who translators of this eulogy was Mehmed Said Efendi, sheikh of Uskudar Salimiya Takka, who lived in the 19th century. His work named Ṭarab-angiz (meaning Pleasure-provoking) is a condensed commentary with ornate prose of Qaside-i Khamriyya. In previous studies, Ṭarab-angiz was partly examined, and there was no mention about the identity and personality of the author. In the present research, the life and personality of Meḥmed Said Efendi is explained and the text of his work is examined.Summary: In Turkish literature which developed under the influence of Islam, translations and commentaries have important a place along with original texts. Coming within the sphere of Islam in early 10th century, Turks embarked on translating the texts immediately in order to learn their new religion and to perform its practices and continued to do so since then. Because they lived in the same culture and civilization climate, Turks learned Islam from Persians and were influenced by Persian language. However, adherents of this new religion also made direct translations from Arabic texts. The translations initially were made from religious works, but in time social, cultural and literary works, such as Persian classics and major eulogies of Arabic Literature, were also translated into Turkish by Turkish scholars. Qaside-i Burde by Ka‘b b. Zuheyr’in (d. 24 AH/645 AD), Qaside-i Nūniyye by Ebu’l-Fetḥ Busti’nin (d. 400 AH/1010 AD), Qaside-i Ṭanṭarāniyye by Ṭanṭarāni’nin (d. 485 AH/1092 AD), Qaside-i Münferice by Ibnu’n-Naḥvi’nin (d. 513 AH/1119 AD), Qaside-i Emāli by Ali b. Othman al-Ushi’nin (d. 575 AH/1179 AD) and famous eulogy named Qaside-i Bur’e by Muḥammed b. Said al-Buṣiri’nin (d. 695 AH/1296 AD) were among such works.Qaside-i Khamriyya by sufi poet Ibn-i Fārıḍ (d. 632 AH/1235 AD), also called sultan of minstrels, in which he explained divine love through wine attracted great attention in Islamic world and was translated into many languages and many commentaries were written on it. One of the commentary writers about this eulogy is Meḥmed Said Efendi, a 19th century sufi. His work entitled Ṭarab-angiz is a condensed commentary with ornate prose of Qaside-i Khamriyya.Studies conducted so far has partly dealt with the Ṭarab-angiz and identity and personality of Meḥmed Said Efendi have never been mentioned. Ṣarac mentioned, “It is a printed work but its writer, printing date, and the place was not found on the printed work”, while Yıldırım used the expression of “a work whose writer and production date is not known.” In his Ph. D. thesis entitled Translation and Commentary Tradition in Classical Turkish Literature in Anatolia, Ṣadık Yazar noted that the work belongs to Meḥmed Said, which was later cited by Aqdag. The final statement on this issue was made by İnce in his work entitled Arabic, Persian and Turkish commentaries of Qaside-i Khamriyya by Ibnu’l Fārıḍ. He examined a total of 18 commentaries and stated that no information is available about the life of Meḥmed Said although he mentioned Ṭarab-angiz.The birth date and place of Meḥmed Said Efendi are unknown. He is grandchild of Ali Behjet Efendi (d. 1238 AH/1823 AD), one of sheiks in Salimiya Dervish Lodge in Uskudar and son of Meḥmed Hidāyetullah Efendi (d. 1288 AH/1871 AD). Following the death of his father, Meḥmed Said Efendi himself served as the head dervish of this dervish lodge for 25 years and became a famous figure. He died in 1313 AH/1896 AD and was buried in the cemetery of the Salimiya Dervish Lodge.Meḥmed Said Efendi was the sixth sheikh of Salimiya Dervish Lodge. In many sources, he was mentioned as a venerable, righteous, devoutly religious, virtuous, polite and scholarly man. Meḥmed Said Efendi is thought to be a member of Mavlavi lodge of Naqshbandi Ṭariqa. He had successors such as Naqshi sheikh Uskudari Balabani Ḥasan Ḥusnu Efendi (d. 1347 AH/1928 AD) and Ismail Efendi (d. after 1307 AH/1890 AD). The poet had a commentary named Ṭarab-angiz in prose form and had a quatrain within the praising eulogy of Sheikh Ḥāmil Efendi (d. 1322 AH/1904 AD), head sheikh of Beylerbeyi Bedevi Dervish Lodge.It is clear from the expression, “A work by Meḥmed Said, the Imam of Central Dervish Lodge of Sultan Salim III,” at the beginning of Edition no: 450 in Suleymaniye Library, Pertev Pasha Collection and from the record of “Work: Ṭarab-angiz, Author: Ibnu’l-Fārıḍ, Translator and postscript writer: Meḥmed Said” in Edition no: 7350 of Marmara University Faculty of Theology Library that this work belongs to Sheikh Meḥmed Said Efendi. However, exact production date of this printed work is not known. The work consisted of 28 pages and in some editions a two-page correct-false chart was added.As usual, the work starts with an introduction section with expressions of “By the name of God, the Most Gracious, the Most Merciful,” “Praise be to God,” and “Peace be upon Prophet Moḥammad.” This section also includes a praise for followers of Prophet Moḥammad, “Who made sphere of prophecy an eternal rose garden through the holy light of their enjoyed manners in addition to making the Shari’a candle shined and and converting them to great flowers of service with their strong inspiration torchs.” The commentator then embarked on praising Qaside-i Khamriyya, mentioning that the men of ability became helpless in explaination of beauty, charm and freshness of unique expression richness and refined allegory blossoms of the eulogy and that reaching the shore of rhetoric could be possible through diving into the guided wisdom of sea. In fact, according to commentator, the men of literature should be aware of the difficulty of translating this unique eulogy into Turkish language. However, everyone should dive into the sea of insight as a knowledge diver, collect its share in pearls of utterance and in emeralds of wits, arrange and put them in the string of prose”. Therefore, he wrote the commentary about the eulogy as a service to humanity and as a contribution to his own stock of comfort in the present and afterlife as much as he could, no matter how little it could be, and named it Ṭarab-angiz. Like most commentators of Qaside-i Khamriyya, Meḥmed Said Efendi commented on only about 33 couplets of the eulogy which contained a total of 41 couplets, and did not cover couplets from 23 to 30 in his work. The commentator used couplet-by- couplet translation method and started with praising for Ibn-i Fārıḍ and his couplets. Then, he gives the Arabic originals of the couplets and starts commentary with the expressions such as “couplets of great intuition, imagery couplets, product of couplet, enlightenment of couplet and concept of couplet.” In preface section of the work, the commentator, who usually quoted hadith texts in Arabic and poems, does not use them in his commentary. He only uses some lines of Arabic prayers and a quatrain of Molla Cāmi (d. 898 AH/1492 AD). This is a quatrain rubāi in Persian language meaning that “If you want no sorrow and no grief of the destiny, drink wine in a pub, because swirling of the goblet and worries of the world do not share the same place just as the tune and the sorrow do not coincide.” The lack of touching on the meaning of words, etymological structure and grammar rules in couplets makes it different from others, except the translation of Aḥmed Ṣāfi Bey. Söz konusu rivâyette İhlâs Sûresini sürekli okuduğu için yüksek derecelere erişen ve cenazesine Cebrâil’le birlikte 70 bin meleğin saflar halinde katıldığı Muâviye b. Muâviye’den bahsedilmektedir. Muâviye vefat ettiği sırada Tebük Gazvesi’nde bulunan Hz. Peygamber’e Cibrîl bizzat gelerek onun vefatını haber vermiştir. Cibrîl ayrıca Resûlullah’ın Muâviye’nin cenaze katılması için dağları tepeleri aralayarak yeryüzünü dürmüştür. İhlâs Sûresi’nin faziletiyle ilgili olağanüstü hallerden bahseden Muâviye b. Muâviye rivâyeti Enes b. Mâlik (...) ve Ebû Ümâme’den merfû, Hasan-ı Basrî ve Saîd b. Müseyyeb’den mürsel olmak üzere toplam dört kişiden nakledilmiştir. Çalışmamızda, hadisler hakkında sıhhat hükmü verebilmek için öncelikle isnaddaki râvîlerin cerh-ta‘dil durumları tespit edilmiştir. Muâviye b. Muâviye hadisinin isnad analizi, rivâyetin ulaşılabilen bütün tarikleri üzerinden yapılarak her bir tarik ayrı ayrı değerlendirmeye tabi tutulmuştur. Sözkonusu rivâyetlerin metin analizi ise rivâyetlerdeki lafız ve muhteva farklılıkları üzerinden yapılmıştır. Metin analizi, rivâyetlerin önce kendi içinde daha sonra diğer hadislerle mukayesesi şeklinde yapılmıştır. Rivâyetler arası karşılaştırmalar yapılırken önce kendi içlerinde ortak bir kompozisyon oluşturulmuş daha sonra diğer rivâyetleri birbirleriyle karşılaştırma yöntemine başvurulmuştur. İsnad ve metin analizinin sonunda Muâviye b. Muâviye rivâyetinin kaynak değeri tespit edilmiştir. (shrink)

IX. yüzyılda Horasan bölgesinde ortaya çıkan Melâmiyye, XXI. yüzyıla kadar varlığını sürdürmüştür. Hamdûn el-Kassâr’ın (ö. 884) temsil ettiği Melâmetiyye-i Kassâriyye, Hacı Bayram-ı Velî’nin (ö. 1430) halifesi Ömer Dede Sikkînî’nin (ö. 1475) temsil ettiği Melâmetiyye-i Bayramîyye ve Muhammed Nûrü’l-Arabî’nin (ö. 1888) temsil ettiği Melâmetiyye-i Nûriyye olarak 3 dönemde incelenmektedir. Melâmîliğin bu devrelerine dair akademik düzeyde çalışmalar yapılmış olsa da mûsikî yönüne dair çalışmaların çok az olduğu görülmüştür. Bu çalışmanın evreni Nûriyye Melâmîleri, örneklemi ise Nûriyye Melâmîlerine dair mûsikî ile ilgili çalışmaları kapsamaktadır. (...) Çalışmada Nûriyye Melâmîlerinin edebi ve sanatsal yönü araştırılmış, literatür taraması aşamasında Melâmî tekke ve derneklerinde icra edilen ilahilere güfte olarak kaynaklık eden Melâmî Efendilerine ait divanlar incelenmiştir. Çalışmamızın amacı Melâmî divanlarında yer alan ve ilahi formunda bestelenmiş güfteleri tespit etmek ve bu ilahilerin yaygınlığını belirlemektir. Nitel araştırma yöntemi kullandığımız çalışmamızda birincil veri kaynaklarını; Melâmîler tarafından bizzat kaleme alınan divanlar ve yine Melâmî ihvanı ile yapılan görüşmeler oluşturmaktadır. İkincil veri kaynaklarımız ise Melâmîlik hakkında yazılan tasavvuf kitapları, makaleler ve Melâmî derneklerinin resmi sayfalarında yer alan mevcut bilgilerdir. Tespit edilen divanlardaki bestelenmiş ilahiler için ise Melâmî Divanları, Devlet Nota Arşivi, Cüneyd Kosal Nota Arşivi, Divan Makam ve Notam v1.0 (Aytaç ERGEN) programı üzerinden taranmış, eşleşen ilahiler çalışmamıza dâhil edilmiştir. Nûriyye Melâmîlerine ait 14 adet divan incelenmiştir. Bu divanlar Abdurrahîm Fedâî, Ali Örfî, Ömer Lütfî, İştipli Hacı Salih Rıf’at, Abdulmâlik Hilmî, Hulûsi Maksud, Hüseyin Şemsi Ergüneş, Hasan Fehmi Tezdoğan, Üsküplü İsmail Hakkı, Hafız Ahmet Fethî, Hüseyin Sabri Soyyiğit, Ahmet Soyyiğit, Yaşar İhsan Gülver ve Dâvud Yılmaz’a ait divanın arasından 8 tanesinde yer alan 97 adet ilahinin notaya alındığı tespit edilmiştir. Verilerin değerlendirilmesi aşamasında; yapılan bu bestelerin hem Melâmî tekke ve meclislerinde hem de tekke dışında icra edildiği, bu bağlamda Nûriyye Melâmîlerinin edebi ve sanatsal yönünün tekke dışında da etkin olduğu görülmüştür. Araştırmanın sonucunda Abdurrahîm Fedâî Divanında yer alan 1’i nefes, 1’i deyiş (bu nefes ve deyişler ilahi formu altında listelenmiştir), 12’i ilahi olmak üzere toplam 14, Ömer Lütfî Divanında yer alan 1, Salih Rıf’at Divanında yer alan 2, Hasan Fehmi Tezdoğan Divanında yer alan 20, Üsküplü İsmail Hakkı’ya ait olduğunu tespit ettiğimiz 1, Ahmet Fethi Divanında yer alan 26, Ahmet Soyyiğit Divanındaki 21, Dâvud Yılmaz Divanındaki 12, toplamda 97 eserin ilahi formunda farklı bestekârlar tarafından bestelendiği tespit edilmiştir.
